  • Most members of family businesses are unnecessarily paying Employment Insurance Premiums (formerly called Unemployment Insurance premiums). This can cost themselves and their companies thousands of dollars per year. If these family members were to ever try and collect benefits they would be denied. It simply makes no sense to keep paying into a fund when you have no chance of collecting if you ever need to. It makes much more economic sense to take that money and invest into your own RRSP or other savings vehicle. By the same token the company can invest the monies that it has been paying into the Employment Insurance fund into other areas.

  • A refund of EI would indeed have a positive effect on the cash balance of both your company and the individuals involved. In procuring an EI refund there is a specific approach that has to be addressed. An EI ruling needs to be applied for detailing the relationship between employer and employee and addressing key issues involved in the factors determining whether an EI refund is warranted. The paperwork filed to recover an EI refund consists of a PD24 EI ruling application where one details the rationale for filing for the refund of ei premiums.

    Employment Insurance is necessary to provide cash flow if one is laid off from their job. However if one is denied the EI benefit when most needed then why should one continue to pay the EI premium? It makes no sense!!! This is the catch-22 situation in which family member employees often find themselves. They have been paying EI for years but cannot avail themselves of the EI benefit when needed.     The terms themselves can be confusing. We are often asked about EI, EI refunds, Employment insurance, EI insurability. even the old term i.e. “Unemployment Insurance” People even think that the words are combined i.e. “Eirefund” as though the terms are synonamous not realizing that a person can not automatically be entitled to an “eirefund”. One has to apply for and be specifically exempted through the ruling process.

    After filing the applicable paperwork to apply for the EI refund a CRA rulings officer will determine the EI status of the individual.
